Seller's Leaseback Option After Closing
Seller's Leaseback Option After Closing
Life doesn't always line up perfectly with a closing calendar. If you're building a new home that faces construction delays, or if you simply need your children to finish out their school semester before relocating, a Seller’s Leaseback Option (formally known as a Seller's Temporary Residential Lease) can be an absolute lifesaver.
In a leaseback scenario, you proceed with closing the sale of your home exactly as scheduled. You receive your hard-earned equity and transfer the deed to the buyer. However, instead of moving out immediately, you legally transition from the "Owner" to a "Tenant," while the buyer becomes your "Landlord" for a brief, defined window. Per the Texas Real Estate Commission (TREC) guidelines, these temporary agreements are strictly capped at a maximum of 90 days. Exceeding this limit pushes the agreement into standard landlord-tenant territory, which can inadvertently trigger violations with the buyer's primary residence mortgage terms.
The financial mechanics are straightforward: a daily rental rate is negotiated, traditionally calculated by dividing the buyer's new monthly housing cost (Principal, Interest, Taxes, and Insurance—or PITI) by 30. A security deposit is held in escrow, just like a traditional lease. As a tenant, you maintain the obligation to keep the property clean, mow the lawn, and pay the utilities, and you must secure a tenant's insurance policy (HO-4) to protect your personal belongings, since your previous homeowner's coverage terminates at closing. It is a highly effective tool that completely eliminates the stress and expense of a chaotic double-move.
